1. Agreement to Terms

By accessing or using nstantcode, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Service Description

nstantcode provides hosted development environments for web and mobile projects. You can work through the browser interface or authorize a compatible AI client through the remote MCP connector. Key capabilities include:

• Project source editing and file history
• Terminal commands in managed cloud development environments
• Managed backend and PostgreSQL database features
• Built-in AI coding features
• Connections to compatible AI clients, including ChatGPT, Claude, Codex, Cursor and Windsurf
• Live previews and publishing for supported web projects; mobile templates provide scaffolding and do not by themselves publish to app stores

3. Account & Eligibility

You must create an account to use nstantcode. You are responsible for maintaining the security of your account credentials. You must be at least 16 years old to use the service.

4. Your Code & Data

For hosted projects, nstantcode stores and processes project source files, metadata and file history to provide editing, cloud development environments, previews and publishing. Project checkouts can also be synchronized to private GitHub repositories. An AI client you authorize through MCP can read and change projects owned by your connected account, run supported commands, access project databases and configuration, and publish supported applications. Data handling is described in our Privacy Policy.

You retain full ownership of the code, content and data you create or provide, subject to applicable third-party licenses. We make no claim to any intellectual property you create or access through the service.

5. AI Usage

nstantcode includes built-in AI agents that run within the browser IDE. When you use built-in AI features, your prompts and relevant context are sent to third-party AI providers (Anthropic, Google, OpenAI) to generate responses. We do not use your data to train AI models.

When you connect an external AI client through MCP, the client receives the results of the tools it calls, including requested project content. nstantcode processes these requests and keeps operational metadata as described in the Privacy Policy. Your AI provider processes your conversation and tool results under its own terms and privacy policy.

6. Acceptable Use

You agree not to use nstantcode to:

• Violate any applicable laws or regulations
• Distribute malware, engage in unauthorized access, or perform attacks against any systems
• Abuse the service infrastructure, including excessive resource consumption intended to degrade service for others
• Resell, sublicense, or redistribute the service without written permission

7. Billing & Subscription

nstantcode offers free and paid plans. Paid plans are billed on a recurring basis (monthly or annually). All prices are displayed at the time of purchase and may be subject to applicable taxes.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the period expires.

8. Refund Policy

We offer a money-back guarantee within 7 days of purchase. If you are not satisfied, you may request a refund proportional to your unused credits. For example, if you have used 30% of your credits, you will receive a refund of 70% of the purchase price. Refunds are processed to the original payment method.

After the 7-day window, we do not offer refunds for partial billing periods. If you believe you were charged in error, contact us and we will resolve it.

9. Service Availability

We aim to keep nstantcode available at all times, but we do not guarantee uninterrupted access. Hosted project features depend on our cloud infrastructure and the third-party services used to provide them. Downtime may occur for maintenance or unforeseen issues. Keep backups or exports appropriate to your needs.

10. Limitation of Liability

nstantcode is provided 'as is' without warranties of any kind. To the maximum extent permitted by law, nstantcode shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your access to nstantcode ends. Retention and deletion of account and project data are described in our Privacy Policy.

12. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via email or an in-app notice. Continued use of the service after changes constitutes acceptance of the updated terms.
